INTRODUCTION
By enrolling in SmartCredit (the "Product"), you are agreeing to this SmartCredit Service Agreement (the "Agreement"), which hereby incorporates by reference the Terms of Use, of ConsumerDirect, Inc., a Nevada corporation ("ConsumerDirect" or "we" or "us"), the owner of the Product, as if fully set forth herein. In the event of any conflict or inconsistency between this Services Agreement and the Terms of Use, this Services Agreement shall control as to the Product. This Agreement and the Terms of Use constitute a legally binding agreement between you and us and collectively govern your use of the Product. Capitalized terms not otherwise defined herein shall have the meanings set forth in the Terms of Use.
Depending on how you access SmartCredit, the Product may from time to time be presented or offered to you through one of our third-party business partners and/or may include a third-party business partner's name or branding alongside our name and branding. Notwithstanding the foregoing, your contractual relationship with respect to the Product is solely with ConsumerDirect.
IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU MUST NOT ENROLL IN THE PRODUCT.
ARBITRATION NOTICE AND CLASS ACTION WAIVER: THIS AGREEMENT IS SUBJECT TO AN ARBITRATION CLAUSE AND A CLASS ACTION WAIVER. SEE SECTION 17 OF THE TERMS OF USE.
Your Product subscription is an all-in-one membership that may include but is not limited to the Smart Credit Report & Scores, ScoreTracker, ScoreBuilder, ScoreBoost, Credit Monitoring, Alerts, and Money Manager. Please see the Product Pricing page for current plans, features, and pricing options.
- Memberships, Billing, And Cancellation.
- Purchasing a Subscription. We charge a subscription fee to enroll in, access, and use the Product. By clicking in the Product to purchase a subscription, you are agreeing to purchase a recurring subscription in accordance with the Terms and any additional terms displayed to you within the Product at the time of purchase, including without limitation a recurring fee at the rates we then charge as set forth in the Product. The Product may from time to time make available different membership plans and subscription fees. Please see the Product Pricing page for current plans, features, and pricing options. You may change your membership plan at any time by clicking here.
- Billing. We will bill you your first monthly subscription fee upon enrollment in the Product or upon the expiration of any promotional period. If you change your plan, we will bill you for the increased plan starting on your next regularly scheduled payment date. You may only change your plan one time in any billing cycle. Thereafter, we will bill you monthly for renewal unless you have canceled your membership prior to any renewal date. If your recurring bill date does not occur in a particular month (e.g. the 31st), then we will bill you on the last day of that month instead. We may from time to time introduce alternative billing periods such as annual memberships. In such event, your billing will be completed as explained to you at the time of your enrollment in such a membership. By providing a payment method, you authorize us and our payment processor or any applicable Business Partner to charge your payment method on file on each billing date and otherwise as may be necessary to collect all applicable fees and charges you owe us. If your issuer, network, or payment processor replaces, re-issues, or updates your payment method (e.g. via a card-network account-updater service), you agree that we shall be permitted to charge such replacement or updated payment method without further notice.
- Obligation to Pay Fees. You agree to pay all fees for any subscription you purchase until your subscription is canceled by you or by us in accordance with the Terms. If you cancel, your cancellation will take effect at the end of the current paid subscription term. You will not receive any pro-rata refund for any amounts paid under a subscription license. We may automatically suspend or terminate your subscription if any payment owed by you does not successfully process for any reason or is subject to a chargeback.
- Cancellation. You may cancel any subscription at any time by (1) clicking here and logging into your account, or (2) calling our customer service department at (877) 372-3895.
- In-Product Purchases. Certain Product features, e.g. 3-Bureau Credit Report & Scores, require that you pay fees in addition to your membership subscription. Any such fees will be displayed to you at the time of purchase, and you will be charged for such fees at the time of purchase.
- Changes in Fees. We may change the fees associated with any subscription or any Product features at any time in our sole discretion, with advance notice to you. If you do not agree to any increased subscription or other fees, your sole recourse is to cancel your subscription prior to its auto-renewal or not to make the applicable in-Product purchase, or you will be responsible for paying all increased fees.
- Taxes. You agree to pay all applicable taxes incurred in connection with any transactions made through your User Account.
- ALL PAYMENTS FOR SUBSCRIPTIONS AND OTHER FEATURES ARE NON-REFUNDABLE. WE DO NOT ISSUE REFUNDS OR CREDITS FOR PARTIALLY USED SUBSCRIPTION PERIODS OR FOR UNUSED FEATURES, EVEN IF WE CHANGE OR ELIMINATE FEATURES OF THE PRODUCT. IF YOU NO LONGER WANT TO BE CHARGED ON A RECURRING MONTHLY BASIS, YOU MUST CANCEL YOUR SUBSCRIPTION PRIOR TO THE END OF THE PERIOD THAT YOU HAVE ALREADY PAID FOR.
- Membership Features. Please note that the following is not a guarantee that we will
continue provide any specific Product features. While we reserve the right to change, suspend, remove,
or disable access to the Product or any features or functionality thereof, at any time with or without
notice, your membership may include some or all of the following features. Please refer to your
membership plan for more details.
- Smart Credit Report. This is a revolutionary new type of tool and is not to be confused with a traditional credit report. What makes it so different is how information is shown to you and how you can interact with your creditors by using Action buttons. It also has a zoom feature to see more credit details and even your daily transactions that ultimately comprise the information reported by a credit reporting agency.
- Optional 3-Bureau Credit Report & Scores. You may separately purchase one or more 3-Bureau Credit Report & Scores ("3B Reports"). Such optional 3B Reports may be ordered no more frequently than once per day. Purchased 3B Reports will be available in your User Account for a period of twelve months.
- Scores and ScoreTracker. Each of your Scores has a number ranging from bad to
excellent, along with a letter grade and how you compare to others. You also get a detailed
overview of your Scores. All Scores are estimates and are for educational purposes only. They
cannot be used to determine final credit.
- Credit Score. This is your credit score, and its number range is 300 (bad) to 850 (excellent). This score is a general representation of your credit risk lenders use (together with multiple other factors) to assess creditworthiness and determine whether to grant credit. The Product generally provides you with your VantageScore 3.0 Credit Score from one or more of the three major credit bureaus. VantageScore is a registered trademark of VantageScore, LLC. Any credit score is based on the information in your credit file at the time it is requested. Your credit file information can vary from agency to agency because some lenders report your credit history to only one or two of the credit bureaus. Therefore, your credit scores can vary, particularly if the information on file for you at the various credit bureaus differs. Since the information in your credit file can change over time, your credit scores may also change on a day-to-day basis. Different credit scoring models can also give a different assessment of the credit risk (risk of default) for the same consumer and same credit file. Further, your lender may not use VantageScore 3.0, so you may receive a credit score from a lender that differs from the score you obtain through the Product. We also reserve the right to use our own internally developed credit score, depending on the ability of a given credit report to generate a normal credit score.
- Auto Score. This number is generated by ConsumerDirect and not the credit bureaus. It represents your estimated possible risk to lenders if you purchase or lease a vehicle. This number is for educational purposes only and is not accessible to lenders, nor may it be used when evaluating creditworthiness.
- Insurance Score. This number is generated by ConsumerDirect and not the credit bureaus. It represents your estimated possible risk to an insurance company if they are underwriting your insurance. This number is for educational purposes only and is not accessible to insurers, nor may it be used when evaluating creditworthiness.
- Hiring Risk Index. Many employers are allowed to view your credit report (not your credit score) when making hiring or promotion decisions. The Hiring Risk Index is a grade generated by ConsumerDirect and not the credit bureaus. It can help you better understand how employers may interpret your credit report. This grade is for educational purposes only and is not accessible to employers or potential employers, nor may it be used when evaluating fitness for employment.
- ScoreBuilder. ScoreBuilder is a 120-day program to help you better understand what may be helping or hurting your credit score and view possible actions you can take on your own. DISCLAIMER: ScoreBuilder does not recommend, advise or guarantee any action or any result. Any action taken is entirely up to each individual person. ScoreBuilder is not credit repair, and no action is ever sent to any Credit Reporting Agency, and therefore it is not subject to regulation under any Federal or State Credit Repair Organization Act.
- ScoreBoost. ScoreBoost is a simulator that helps you plan your future credit score and know when it may be best to apply for credit. By using ScoreBoost, you can see how making payments and by when can potentially increase your credit score. You can also see how spending may lower your credit score and by when. ScoreBoost is also a great educational tool to better understand how your credit score works. DISCLAIMER: ScoreBoost is a credit score simulator designed for educational purposes only. Results are not guaranteed and should not be relied upon. ScoreBoost is a simulator showing possible outcome of your credit score based upon certain actions you may optionally take that affects the statement balance reported by your creditor or bank. ScoreBoost is not credit repair service, is not credit counselling or a debt management plan.
- Future Score. Future Score takes your current score and adds the estimated additional points you may be able to increase your score as estimated by ScoreBuilder and ScoreBoost. Future Score is only an estimate, for educational purposes only, and there is no guarantee that you will be able to achieve any Future Score displayed to you
- PrivacyMaster (if applicable to your Membership Plan).
- PrivacyMaster can assist you in exercising your privacy rights with various entities that control and process your personal information.
- When you enroll in the Product and PrivacyMaster is an available feature of your membership, PrivacyMaster will automatically use your personal information to scan third-party sites including but not limited to data brokers, businesses, non-profit organizations, and governmental agencies. Scanning is automatic and does not depend on whether you activate the PrivacyMaster feature. If you do not desire PrivacyMaster to use your personal information to scan such third-party sites, you must unenroll from the Product and any other credit monitoring that we may provide you.
- When PrivacyMaster detects that a third-party site may contain your personal information, PrivacyMaster will send you an alert in the Product. Please note that PrivacyMaster is not intended to and cannot and does not guarantee that it will locate all instances of your personal information on third party sites but is made available on an as-is and where-is basis.
- If you have enabled PrivacyMaster (which may require activation of our Fraud Insurance benefit), then, after receiving a PrivacyMaster alert, you can select whether you want PrivacyMaster to send a request to the third-party site (a "PrivacyMaster Request"), or you can ignore the alert. Each time you make a PrivacyMaster Request, you authorize us and our licensees, successors, and assigns, to collect, compile, process, and display your personal information (in complete and/or redacted form), to make your personal information available to third parties to whom we submit requests on your behalf, to display this information to you via the Product, and to communicate with such third parties, on your behalf regarding your rights in and to your personal information. This includes, as directed by you, the right to submit complaints on your behalf, with your consent, regarding violations of your privacy, consumer protection, confidentiality, data security, or similar laws, regulations, obligations, or requirements, or under private contracts or commitments (including the privacy notices, terms of service, and other representations from companies regarding the processing of your personal information). You authorize us and grant us the right to exercise such rights and privileges on your behalf, including, without limitation, the right to access and receive the categories and specific pieces of personal information about you (which may or may not be known by you), the right to request deletion of your personal information, the right to opt-out of certain processing activities (like the sale of personal information), the right to restrict the use of your personal information, the right to request correction of your personal information, and the right to receive personal information from third parties in fulfillment of your rights and privileges.
- If you have made any PrivacyMaster Request, you can cancel the request at any time, and within a reasonable time thereafter, we will take no further action with respect to such cancelled PrivacyMaster Request. However, your cancellation will not stop or retract any communications previously submitted or in process.
- If you send a PrivacyMaster Request, we will monitor compliance with your removal instructions.
- You will receive periodic alerts with updates and results. Your results may take from 1 to 45 days depending upon the responsiveness of the website or data broker compliance with your instructions.
- Results are not guaranteed and may vary.
- Alerts & Credit Monitoring.
- The Product monitors information that is posted to a credit reporting agency (specifically TransUnion) or financial accounts once you add them to Money Manager (described below). Some monitoring Alerts you may receive are more important and urgent than others.
- In addition, you will receive various Alerts informing you of the latest concerning your Money, Credit and Privacy. These may include Alerts about your Membership, credit monitoring, identity theft alerts, creditor responses to your Actions, and when payments are due on certain accounts that you link to Money Manager.
- Please adjust your email and phone settings to ensure that you receive Alerts and that they are not flagged as spam or junk. If you believe you are not receiving Alerts, please contact us. Further, you agree to update your email address and other contact information with any changes during your membership.
- Credit monitoring Alerts may take 48 hours to start, but may be delayed due to circumstances beyond our control. If we are unable to initiate your credit monitoring for any reason, we will contact you.
- You understand that the term "Alerts" is only a name and general description of a Product feature. It is not intended to mean and does not guarantee any particular level of timeliness or protection of your credit or identity. Alerts are provided as-is, and we make no guarantee regarding Alerts. You remain solely responsible for monitoring your own credit and identity.
- Fraud Insurance (if applicable; not available with all memberships; requires
activation).
- Your $1 Million Fraud Insurance ("Fraud Insurance") is underwritten and administered by Voyager Indemnity Company, an Assurant Specialty Property Company ("Assurant") under a master group policy issued to ConsumerDirect for the benefit its end users.
- BASED ON YOUR MEMBERSHIP, FRAUD INSURANCE MAY NOT BE AUTOMATICALLY ACTIVATED WHEN YOU ENROLL AS A MEMBER. YOU MUST ACTIVATE YOUR FRAUD INSURANCE BY CLICKING HERE.
- The complete Fraud Insurance policy is available in the Fraud Insurance section of your User Account. Please note that residents of New York and Texas may be subject to certain restrictions or prohibitions with respect to Fraud Insurance.
- Assurant administers all claims and ConsumerDirect, Inc®. shall have NO responsibility with respect to ANY Fraud Insurance benefit.
- Money Manager.
- Generally. Money Manager allows you to organize your personal finances by linking your online accounts such as your bank accounts, credit cards, loans, mortgages, and investment accounts. You understand that we use third parties to gather this information electronically from online accounts you have established with third parties. Not all information shown on your third-party online accounts may be available to you in Money Manager after you link. Information is typically updated every 24 hours, but we are unable to and do not make any guarantee of accuracy, interval of updates, or intraday pending transactions. You understand that, from time to time, your username, password, and other authentication may be required to continue your link to your online account(s). You are representing that you have all legal rights and privileges to access and link to third party online accounts that you opt to link to Money Manager. You may unlink any accounts at any time in the Product. Details of any linked accounts are shown in Money Manager located on your Product home page and are also attached to your creditor data on the Smart Credit Report. If you view a creditor in your Smart Credit Report, the transactions will appear as well.
- Bill Delivery and Presentment. You may use Money Manager to request
presentment of electronic bills from payees. This feature is for the presentment of
electronic bills only, and it is your sole responsibility to contact your payee directly
if you do not receive your payee statement. This feature is not a substitute for
receiving your bills directly from such payees, and you remain solely responsible for
monitoring and timely paying your own bills, regardless of whether or not Money Manager
is able to present such bills to you on a timely or complete basis. You agree to
indemnify and hold us and our service providers harmless should the Product or any payee
fail to deliver any bills or fail to do so in a timely manner. By registering for and
using Money Manager to request presentment of electronic bills, you authorize us and our
service providers and agents to undertake the following actions on your behalf:
- Access third-party websites, including websites maintained by payees designated by you, to retrieve your account and billing information; and
- Use information you submit to us or our service providers (such as account passwords and usernames) to provide and configure Money Manager.
- Disclosure. Money Manager uses a tokenized widget provided by MX Technologies, Inc. ("MX") to obtain account information you may request and display it to you in the Product. When you enable the Money Manager feature in the Product, you authorize us and MX to disclose such information in order to provide Money Manager. You acknowledge and agree that, for the limited purposes described in this section, we and MX will be acting on your behalf and as your agent, and any actions we or MX take on any payee or other third-party websites shall be deemed actions taken by you to enable your use of the Money Manager feature. Except for our relationships with our service providers, you understand that we have no relationship, affiliation, or connection with any third-party websites available for linking through Money Manager. Money Manager is not endorsed or sponsored by any such account providers. We assume no responsibility for, and we shall incur no liability with respect to, the acts, omissions, or determinations of any such third-party website. You acknowledge and agree that Money Manager may not maintain the same level of security against unauthorized access to your account information as the third-party websites from which you authorize us to retrieve information on your behalf.
- Personal Information. Money Manager is unable to update or change your personal information, such as, but not limited to, name, address, phone number(s) and email address(es), that you have established with any third party. You will need to make any such changes by contacting the payee directly. Additionally, it is your responsibility to maintain all usernames and passwords for any payee accounts you link through Money Manager. You also agree not to use someone else's information to gain unauthorized access to another person's bill.
- Activation. Upon activation of the electronic bill presentment feature within Money Manager, the Product will notify the payee of your request to receive electronic billing information. The presentment of your first electronic bill may vary and may take up to sixty (60) days, depending on the billing cycle of the payee and other factors. Additionally, your ability to receive a paper copy of your statement(s) is at the sole discretion of each payee. It is your responsibility to keep your accounts current. A payee may deny your request to receive electronic bills. In some instances, if you have made a payment to a payee through the bill payment service, the payee may elect to send your bills or monthly statement(s) to you electronically.
- Disclaimer. Money Manager is not responsible for the underlying accuracy of your electronic bill(s). Any discrepancies or disputes regarding the accuracy of your electronic bill summary or detail must be addressed directly with the applicable payee. Your use of Money Manager in no way alters your liability or obligations that currently exist or may in the future exist between you and any payee. Any categorization of transactions or accounts in Money Manager is an estimated categorization provided for your information only, and does not indicate accurate status of any transaction, account, or other information. You agree that you will not rely on any categorization provided in Money Manager or set by you for any purpose, including without limitation, for tax deductions.
- Actions.
- The Product has Action Buttons that allow you to communicate directly with your creditors for any questions, problems, or requests you may have. Using Action Buttons is very fast, you don't need account numbers, and you need to worry about business hours. Best of all, you don't have to talk to anyone. Just push the button. These Actions are no different than if you contacted your creditor directly by telephone or in writing. You are under no obligation to use our Action Buttons.
- We are a neutral platform, and we do not instruct, advise, recommend, or otherwise encourage you to take Actions directly with any creditor. You are solely responsible for any Actions you take with your creditors.
- In order to process your Actions, we collect your financial account and creditor information. We may be required to collect additional identifying information or to verify your information by using third-party sources. You agree to provide any additional information that we require in connection with your Actions.
- When a creditor replies to your Action request, they may reply through our system, in which case the Product will generate an Alert. Alternatively, the creditor may reply directly to your personal contact information in its files. A creditor's reply may vary depending on the general responsiveness of the creditor and your specific Action request. Please allow reasonable time for your creditor(s) to respond to your Action(s).
- A creditor may reply to an Action request with acceptance, denial, counter-offer, or a request for more information. In some cases, a creditor may not respond at all. In other cases, multiple Actions may be required to get the result you desire.
- Results or replies to your Action(s) are not guaranteed. Delivery of your Action(s) to a creditor is not guaranteed. We are never responsible for any costs or other damages you may incur as a result of any Actions you make while using our product.
- We reserve the right (but shall not be obligated) to filter your Action requests through our validation and frivolous filter engines designed to avoid abuses, provide continuity, and protect our communications to the source or furnisher of information (i.e. your creditor) that is the subject of your Action.
- We reserve the right to reject any of your Actions for unnecessary repetition, frivolous requests, foul language, or for any other reason in our sole discretion.
- By taking an Action, you certify that the Action initiated by you is appropriate and lawful. In particular, you understand and agree that disputing any valid accounts/charges or inappropriately claiming identity theft may constitute fraud, which is a crime subject to possible fines and/or imprisonment. If we determine that you are using our Product to commit fraud, we will immediately terminate your User Account, and we may report your activity to an appropriate law enforcement authorities.
- You have until midnight, Pacific Time, to cancel any regular Action request, after which the Product will automatically send your Action request. If the Action is noted as an Instant Action, you will have a very limited to in which to cancel such an Instant Action, up to a maximum of five (5) minutes. Please submit Instant Actions with caution as it may be difficult or impossible to cancel them once submitted.
- Actions do not accumulate or roll-over to a subsequent billing period. If you choose not to use your free Action allotment granted to you per each billing period of your membership, they will no longer be available to you. There are restrictions on the number of free Actions your membership plan provides, please see Product Pricing Page for details regarding your selected membership plan.
- Offers. By enrolling in the Product, you grant us your permission to match you with offers and products that may be suited for you, whether through our myLONA feature or otherwise. In accordance with our Privacy Policy, we may disclose your personal information to our Contractors or other third parties, who, upon review of your personal information, may elect to make specific offers of credit or other products and services to you, and they may do so and otherwise contact you, unless specifically prohibited by your opt-out in accordance with our Privacy Policy or by applicable law. You understand there are no guarantees or promises that any products or services will be offered to you or that you will qualify for any products or services that may be offered to you. If you accept any offers, you will be required to complete a credit or other form of application. You are not required to apply for any product or service offered to you, and if you do so, you understand that you do so voluntarily and at your own risk.

- Verification and Permissions.
- You understand that by enrolling in the Product, you are providing us with "written instructions" in accordance with the federal Fair Credit Reporting Act, as amended ("FCRA"), for us and our service providers, which may include one or more of the three major credit reporting agencies (Experian, Equifax, and TransUnion), to obtain information from your personal credit profile. You authorize us and our service providers to use your Social Security number to access your personal credit profile, to verify your identity, and to provide credit monitoring, reporting and scoring products.
- By using the Product, you are giving us your permission to obtain your credit report data from third parties. You understand that our system transforms this data into our Smart Credit Report, which is not a traditional credit report. Your permission for us to obtain your credit data to provide you with the Product shall be valid continuously until you cancel your membership as provided in this Agreement.
- You authorize us and our business partners to be your official payment processing agent to collect payment by automatic credit card or debit card for Product subscriptions and in-Product purchases. You agree to keep your payment information current during the term of your subscription. If your method of payment for any charges described herein fails, you may lose access to your User Account and the Product. We reserve the right to cancel your membership for unsuccessful payment attempts on your method of payment.
- Product Disclaimer. We offer no assurances of the accuracy or timeliness of any information we obtain from a third party, nor any guarantee that we will be able to transform this data for display properly.
- Grant of Limited Power of Attorney.
- For all purposes of this Agreement, including without limitation for Money Manager and Actions, you hereby grant us and our agents and service providers and our respective employees, agents, subcontractors, and assigns, a limited power of attorney, and you hereby appoint us as your true and lawful attorney-in-fact and agent, with full power of substitution and re-substitution, for you and in your name, place and stead, in any and all capacities, to (i) take all actions necessary or desirable to provide the Product any features thereof to you, (ii) use the information contained in your personal credit profile and/or other creditor/sources of information to acquire your credit data, including, but not limited to, credit reports, scores, identification products, monthly credit report monitoring products and profiles, (iii) access third-party websites, retrieve information, and use your information, all as described herein, each with the full power and authority to do and perform each and every act and thing requisite and necessary to be done in connection with such activities, as fully to all intents and purposes as you might or could do in person. YOU ACKNOWLEDGE AND AGREE THAT WHEN WE TAKE ANY SUCH ACTIONS IN FURTHERANCE OF PROVIDING THE PRODUCT AND ITS FEATURES TO YOU, INCLUDING WITHOUT LIMITATION WHEN WE ACCESS AND RETRIEVE INFORMATION FROM THIRD-PARTY WEBSITES, WE ARE ACTING AS YOUR AGENT, AND NOT THE AGENT OR ON BEHALF OF THE THIRD PARTY. We shall have the sole discretion in our professional judgment to determine the specific acts necessary to accomplish the purpose of this Agreement and may also include written and oral communications on your behalf with various agencies and entities such as, but not limited to, sources of reporting, creditors and collection agencies sharing credit information relating to you, so we can acquire your credit information for your use. You specifically grant us the right to engage in such an exchange of information on your behalf with the various agencies and entities disseminating credit data regarding you. You may revoke this power of attorney at any time by canceling your membership.
- CREDIT REPORT DISCLAIMERS
- WE DO NOT PROVIDE CREDIT REPAIR SERVICES OR CREDIT REPAIR ADVICE. WE DO NOT CLAIM THAT WE ARE ABLE TO CLEAN UP OR IMPROVE YOUR CREDIT RECORD, CREDIT HISTORY OR CREDIT RATING. ANY MENTION OF THE WORDS "IMPROVE" OR "GOAL" OR SIMILAR TERMINOLOGY IS FOR EDUCATIONAL PURPOSES ONLY AND DOES NOT CARRY THE SAME MEANING AS CLEANING UP OR IMPROVING ONE'S CREDIT RATING.
- The Smart Credit Report is not a credit report in the traditional sense. Rather, it contains additional data and formatting that is not contained in a traditional credit report. The Smart Credit Report is a patented technology (USPTO 7,818,228). It is used primarily as a communication medium, for consumers to communicate directly with creditors.
- Some of the data within the Product may originate from third parties, such as the consumer credit reporting agencies (credit bureaus). You understand and agree that your access to and use of the Product may be subject to additional restrictions imposed by these third parties. Additionally, you understand and agree that these third parties may need to collect additional personal information from you to verify your identity and provide you access to your information. You agree to comply with all third-party terms and restrictions for which you receive notice, whether such notice is provided in writing or given online, and such restrictions are incorporated herein by reference.

- The Federal Trade Commission and some States' Attorneys General regulate creditors, credit bureaus, and credit care organizations. As a safe harbor statement please know: "You have the right to sue a credit services organization if it misleads you."
- CONSUMER CREDIT FILE RIGHTS UNDER STATE AND FEDERAL LAW. You have a right to obtain a copy of your credit file from a consumer credit reporting agency. They may charge a reasonable fee not to exceed an amount set annually by the CFPB ($15.50 as of 2025). There is no fee, however, if you have been turned down for credit, employment, insurance, or housing because of information on your credit report within the preceding 60 days. There is also no fee if you certify that you are unemployed and intend to apply for employment during the next sixty (60) days, that you are a recipient of public welfare assistance, or that you have reason to believe that your file at such credit reporting agency contains inaccurate information due to fraud. You also have the right to receive one free copy of your credit report from each consumer credit reporting agency per year at the www.annualcreditreport.com web site. The three nationwide consumer reporting agencies, Equifax, Experian, and TransUnion, also provide free weekly online access to your credit reports through that same site. State law may provide additional rights.
- The credit data provided or requested through our Product is not intended to constitute the disclosure of information by a credit reporting agency as defined by the Fair Credit Reporting Act or similar laws.
- In addition, if you reside in the state of Colorado, Maine, Maryland, Massachusetts, New Jersey, or Vermont, you are entitled to receive a free copy of your credit report once a year, and if you reside in the state of Georgia, you are entitled to receive a free copy of your credit report twice a year. Otherwise, a consumer reporting agency may impose a reasonable charge for providing you with a copy of your credit report.
- You have a right to dispute inaccurate, incomplete, or unverified information by contacting the consumer credit reporting agency directly. However, neither you nor any company or credit services organization has the right to have accurate, current, and verifiable information removed from your credit report. Under the Federal Fair Credit Reporting Act, the consumer credit reporting agency and/or the reporting creditor must remove accurate negative information from your report only if it is over seven years old. Bankruptcy information can be reported for 10 years. State law may provide additional or different time limits.
- YOU UNDERSTAND ANY ACTIONS YOU MAY TAKE THROUGH THE PRODUCT DO NOT GO TO ANY CREDIT REPORTING AGENCY/CREDIT BUREAU, BUT ONLY TO YOUR CREDITOR AS YOU SELECT AND INSTRUCT. IT IS YOUR CREDITOR'S SOLE AND ABSOLUTE DISCRETION TO RESPOND TO YOUR ACTION AS THEY DEEM NECESSARY. YOU ARE NOT REQUIRED TO PURCHASE YOUR CREDIT REPORT FROM US TO COMMUNICATE WITH YOUR CREDITORS. YOU MAY COMMUNICATE DIRECTLY WITH YOUR CREDITORS FOR ANYTHING YOU WISH AT ANY TIME.
- If, separately from using our Product, you have notified a credit reporting agency in writing that you dispute the accuracy of information in your credit file, the consumer reporting agency must then reinvestigate and modify or remove inaccurate information. The consumer credit reporting agency may not charge a fee to respond to such a dispute. Any pertinent information and copies of all documents you have concerning an error should be given to the consumer credit reporting agency. If reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the consumer credit reporting agency, to keep in your file, explaining why you think the record is inaccurate. The consumer credit reporting agency must include your statement about disputed information in any report it issues about you.
- Nonprofit credit counseling services are available, usually without fees, to counsel you as to credit management and/or consolidation. Additionally, you may perform many of our Product features, such as our Actions, on your own without the use of the Product. We simply provide tools allowing consumers to communicate with creditors through our Product, if desired.
